Purpose: The Iowa Telecommunications and Technology Commission (ITTC) is required by Executive Order Number Nine to prepare a regulatory plan listing each regulatory action or potential rule currently under active consideration or development within the ITTC, excluding those rules that do not have a substantial impact on the legal rights, privileges, or duties of persons that the ITTC reasonably expects to issue in proposed or final form for Fiscal Year 2002 and annually thereafter. A regulatory plan was submitted on August 1, 2001 and annually thereafter, to the Administrative Rules Coordinator and posted by that date on the Iowa Communications Network's (ICN) website. The ITTC has been notified in writing by the General Counsel, Office of the Governor, that it is not required to provide this plan to any other agency. ITTC has sole rule-making authority for Iowa Administrative Code, Section 751.

Statement of ITTC's current regulatory objectives and priorities and how they relate to the obligations imposed on the ITTC by statute and the Governor's priorities.

The ITTC issues only those administrative rules that are authorized by state law and specifically aid in interpreting Chapter 8D and other law in serving the public need. The ITTC was established by Code of Iowa, Chapter 8D, to coordinate communications of state government, effect maximum practical consolidation and joint use of communications services, and manage, develop, operate, and ensure compatibility of the fiber optic network. The ITTC coordinates with and provides services to all authorized users and operates within the Governor's budget and other priorities.

Description of each contemplated regulatory action, including to the extent practicable, alternatives to be considered and a preliminary estimate of the anticipated costs and benefits of the action.

Administrative Rules amendments may be required if State of Iowa Code changes are needed for the implementation of the Federal ARRA (Stimulus) Broadband Technology Opportunities Programs (BTOP) grant awarded to the Iowa Communications Network in July 2010.

Summary of the legal basis for each action, including whether any aspect of the action is required by statute or court order.

The ITTC is permitted by statute to manage, operate, and provide telecommunications services over the fiber optic network.

Statement of the need for each such action and, if applicable, how the action will reduce risks to public health, safety, or the environment, as well as how the magnitude of the risk addressed by the action relates to other risks within the jurisdiction of the ITTC.

There is no risk identified to public health, safety, or the environment.

The ITTC's contemplated schedule for action, including a statement of any applicable statutory or judicial deadlines.

During July 2010, the Iowa Communications Network was awarded the federal BTOP grant. Administrative Rules changes would be made if legislative is required and approved during the 2011 Iowa Legislative Session.
